A federal judge denied Elon Musk's AI company xAI's request to block Minnesota's first-in-the-nation law banning "nudification" technology — AI tools that generate fake nude or sexualized images of real, identifiable people without consent. U.S. District Judge Donovan Frank ruled the law can take effect as scheduled, finding that xAI's own timeline undercut its claim of urgent harm: the company waited nearly three months after Gov. Tim Walz signed the bill in May before suing on July 27, then asked for an emergency restraining order just three days before the law's effective date. "Such a delay in bringing the action and the motion suggests that harm is not immediate," Frank wrote.
The law, HF 1606, passed the Minnesota House 132-1 and the Senate 65-0 — near-total bipartisan agreement — and imposes civil penalties up to $500,000 per violation on companies whose tools let users generate nonconsensual intimate imagery of real people. It targets the platforms and developers directly, not just individual bad actors. xAI's lawsuit argues the law is an "overbroad, content-based ban" that sweeps up protected speech beyond its stated purpose; notably, the company's own court filings state it "does not contest Minnesota's interest in prohibiting the dissemination of artificially generated nude images of real people without their consent" — meaning xAI isn't defending the underlying practice, just challenging how broadly the statute is written. In response, xAI says it will restrict Grok Imagine's image-editing features for Minnesota users rather than risk the penalty exposure.
Minnesota Attorney General Keith Ellison, who defended the law in court, said simply: "Minnesota's landmark law banning the use of nudification technology will go into effect tomorrow as planned." Gov. Walz was more pointed on social media, addressing Musk directly: "See you in court, creep." A hearing on whether to grant a longer-term injunction is set for August 19, meaning this fight is far from over — but for now, the law stands.
